Guest Rental Agreement
PLEASE READ -- YOU MUST AGREE TO THESE RENTAL
TERMS TO PLACE A RESERVATION.
Thank you for vacationing with us!
In consideration of the rent received and the mutual promise contained herein,
the Owner of the rental property indicated in this agreement, through his/her
Agent, Chincoteague Resort Realty, Inc., (CRR), does hereby grant license to
occupy such rental property for short-term transient occupancy under the
following terms and conditions:
The guest hereby certifies by his/her acceptance below that he/she has received and read a copy of this rental agreement and that the Guest agrees, as witnessed by signatures below, to abide by all rules and regulations contained herein related to the rental property described. Failure to abide by these rules will result in immediate eviction without prior notice and no refunds will be issued.
1. This agreement must be signed and returned, along with any deposit required, within 10 days of the date of reservation booking. If this signed agreement is not received within that time period, your reservation will be cancelled without further notice. All deposits collected shall be placed into an interest bearing account with all interest payment to CRR. Returned checks shall incur an additional charge of $35.00. Guests must be of legal age to enter into this rental agreement.
2. Cancellation – In the event a Guest wishes to terminate this agreement and said rental property is not re-rented for the same period of time at the same rate, no refund shall be made to guest. If agent is able to re-rent the unit under same conditions, then a refund will be made less a 15% processing fee.
3. Deposit- The remaining balance of your reservation payment must be paid 30 days prior to your arrival. If you are making a reservation that will occur within less than a 30 day period, payment IN FULL will be required at time of booking. KEYS WILL NOT BE ISSUED OR POSTED FOR YOU UNTIL YOUR FINAL PAYMENT AND SIGNED AGREEMENT ARE RECEIVED. We do not accept personal checks within 30 days of your arrival.
4. Occupancy- Guest shall not occupy the rental unit with more guests than stated by the maximum occupancy rate indicated in the rental agreement. In no event shall guest assign or sublet his/her rental agreement. Any violation of this rule will result in immediate eviction. Guest grants CRR, or authorized personnel of CRR, permission to enter premise at any time without prior notice for inspection/maintenance/repair purposes. Guests shall not leave minor children unattended in premises.
5. NO SMOKING - all of our vacation rental homes are NO SMOKING units. You may not smoke in any of our units. Guests that violate this no-smoking rule will forfeit their security deposit for cleaning.
6. Pets- NO PETS means NO PETS. If, however, your rental unit allows pets and you have paid the required pet fees, then your pet will be allowed on the premises. Guest is responsible for cleaning the outside area around the unit of all pet excrements. ALL PETS MUST BE HOUSEBROKEN. “Pee pads” are not allowed. Guest agrees to pay a non-refundable pet fee of $75/per pet. Any damage resulting from a pet shall be the responsibility of the Guest and will be deducted from the Guest’s security deposit. Any undeclared pets found on premises without permission, regardless of whether the house is NO PETS or PET FRIENDLY, shall result in immediate eviction of Guest and no refund will be issued. NOTE: Some units do not allow large breed dogs or cats.
7. Refunds- No refunds will be issued due to inoperable systems or appliances including but not limited to pools, hot tubs, heating/cooling systems, etc. in rental units. CRR will make every effort to have malfunctioning appliances/ systems repaired as quickly as possible, however, repairs cannot be guaranteed. No refunds will be given due to inclement weather, power outages, water shortages, flooding, etc. due to hurricanes or other potentially dangerous situations. No refunds will be issued for early departure by Guest.
8. Security Deposits- a security deposit shall be paid by Guest. Upon departure of Guest, the rental unit will be inspected by housekeeping and a written report made. Guest shall be responsible for damage (above and beyond normal wear and tear) and/or missing items, and Guest’s liability is not limited by amount of security deposit collected. Each guest is expected to follow proper check-out procedures posted in the rental unit. Failure to do so may result in loss of some or all of the security deposit. If no damage has occurred and unit is in satisfactory condition, then the Guest’s security deposit will be returned via check to Guest within 30 days of Guest’s departure. GUEST IS RESPONSIBLE FOR NOTIFYING CRR IMMEDIATELY UPON CHECK-IN IF ANY DAMAGE IS FOUND. Security Deposit Waiver from CSA Travel Insurance is available in lieu of paying your security deposit. The fee for this is $39 and this is a non-refundable fee. CRR receives a commission from the SD Waivers that are purchased.
9. Phone- Guests are not permitted to charge long distance calls to the phone number located at the rental unit. In the event Guest makes toll calls that are later discovered, then charges for the calls including a $50 handling fee shall be deducted from the Guest’s security deposit.
10. Lost and Found- CRR would be glad to return items left behind by Guest. A shipping and handling fee of $15 along with required postage will be deducted from security deposit.
11. Linens- Each guest should bring their own linens and towels. Bed sizes are indicated on the reservation confirmation. CRR can make available linens and towels at an additional fee. Linens that are lost, damaged or not returned by guest shall be subject to a charge of $42.00 per sheet set and $22.00 per towel set and such charge will be deducted from the security deposit.
12. Check-in & Check-out Policy: Check-in time is 3:00 p.m., NO EXCEPTIONS. In the event a Guest checks in after normal business hours or on a day that the office is closed, keys will be posted in the Late Arrivals box right outside our office door. An envelope with your name, keys and directions to the unit will be in that box. Check-out time is 10:00 a.m., NO EXCEPTIONS. Guests that do not check out promptly may lose their security deposit. Please notify our office concerning any check-out matters.
13. Keys- two keys will be issued to each guest at check-in. Keys will not be issued until final payment and signed rental agreement is received. NOTE: Keys for Guests that are checking in on Sunday will not be posted in the Late Arrivals box until 3:00 p.m. Guest will return keys to the office by 10:00 a.m. the day of check-out. Guest will be responsible for missing keys. A $10 charge will be deducted from the security deposit for missing keys.
14. Lock-out Policy: Guests that lock themselves out of their unit where an "after normal business hours" call is necessary to gain entrance shall be charged a $25 lock-out fee.
15. Unavailability and Substitution- Rental units are not subject to Guest approval at check-in. In the event that a rental unit becomes unavailable for any reason, the Agent has the right to substitute another rental unit for Guest’s reservation. Guest agrees that CRR’s and Owner’s sole liability as a result of unavailability is limited to a full refund of all monies paid under this agreement and Guest expressly agrees that in no event shall Owner or CRR be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify (hold harmless) Owner and Agent from any liability resulting from injury by any cause to Guest or members of Guest’s party.
16. Parking- PARKING IS LIMITED. Your reservation states the number of allowed parking spaces. Any guest that brings more than the allotted number of vehicles, or boat trailers, etc., may be subject to immediate eviction. Parking in undesignated areas is not permitted and may also result in immediate eviction. If you have questions concerning extra parking during your visit, please call us.
17. Boat Dockage- Boat dockage may be limited, even though there may be dock space on the property you have reserved. Some areas are very shallow and we cannot guarantee water depth. Please let us know if you plan to bring a boat.
18. Tents, Campers, Trailers- Campers, motor homes, tents, portable pools, etc. are not permitted at rental units at any time.
19. Pools- If your unit provides access to a pool for your use, the following rules apply to you and all members of your rental party: GUESTS AGREE TO USE POOL AT THEIR OWN RISK. The Guest named in this agreement must notify all guests in his/her rental party of that condition. No lifeguards are on duty. Furthermore, only guests occupying the rental unit may use the pool. If anyone other than guests staying in the rental unit are found using the pool via your permission, CRR reserves the right to immediately evict Guest without further notice and no refunds will be made.
20. Chincoteague Resort Realty has made every effort to provide accurate information to Guests concerning rental units and amenities offered through print and electronic medium. Guests shall take all responsibility for unit selection, and selection is final upon receipt of Guest’s signed agreement and deposit. Information provided by CRR is deemed accurate, however, cannot be guaranteed. CRR will assume no responsibility for accident, loss, injury or death that occurs at any of our rental properties.
21. Travel Insurance- CSA Travel Insurance is available. The purchase of travel insurance is optional and not required to complete your booking. Questions concerning coverage should be directed to CSA at 1-866-298-6846. CRR receives a commission from the insurance policies that are purchased through CSA.
22. Security Deposit Protection - CSA Security Deposit Protection is available. The purchase of this protection is optional and not required to complete your booking. Questions concerning coverage can be directed to CSA at 1-888-470-9123. CRR receives a commission from the protection policies that are purchased through CSA.
